The government of Quebec has introduced a new law effective today banning the use, while driving of hand-held cell phones that are not operated by a ?hands-free? function. Now, these kind of rules have been done by other governments, but Quebec has one of the most strict implementations of the law
Over the next three months, there is a grace period during which police officers will deliver warnings to drivers. Effective July 1, the law will be enforced. If you are observed using/holding a hand-held cell phone operating without a ?hands-free? function while driving, you will receive a $115 fine (including court costs), plus lose three license demerit points.
Here is some important information from the Qu?bec Government:
- Drivers who are holding a cell phone in their hand are presumed to be using it.
- Any device with a telephone function, such as a Blackberry, is considered to be a cell phone and its handheld use is prohibited by someone driving a car.
- To use a device with a telephone function, you must first bring your vehicle to a stop in a location where parking is permitted.
- Except when necessary, you are not permitted to bring a vehicle to a stop on the shoulder of a highway, on a highway on-ramp or highway off-ramp.
- Drivers who are stopped at a red light or in traffic are still deemed to be driving.
- Use of a hands-free cell phone or other device while driving is permitted. However, you may only dial them if they are in a fixed position on your car, or voice-activated (e.g. Bluetooth), and do not need to be handheld while dialling.
